Bliss Kids’ Clothing Trademark Lawsuit Revived by Split 6th Cir.

Bliss Collection LLC convinced a majority of a Sixth Circuit panel to revive claims a former partner’s “little english” trademarks for children’s clothing may resemble its “bella bliss” logos enough to confuse consumers.

Latham Companies LLC rightly evaded its rival’s trade dress claims, but shouldn’t have so easily escaped claims alleging its light blue marks incorporating a “Le” that “tracks the shape” of Bliss’ lower case “b” infringed, the US Court of Appeals for the Sixth Circuit said. A partial dissent disagreed, calling the marks “so clearly distinguishable” that no reasonable consumer would be confused.
