Blackbeard’s Ship Videographer Revives Claim State Took Work (1)

A videographer who says North Carolina ripped off underwater pirate ship footage convinced a federal court that the year before it killed his copyright claim, the U.S. Supreme Court indirectly breathed new life into a previously dismissed claim.

A 2019 high court ruling in a different case overturned the precedent used to dismiss Frederick Allen’s unconstitutional takings claim in 2017, the U.S. District Court for the Eastern District of North Carolina said. Allen claims the state ripped off footage he took of pirate Blackbeard’s sunken ship, the Queen Anne’s Revenge, to which he had retained rights.
