Black Knight Ordered to Face PennyMac’s Antitrust Arbitration

PennyMac Loan Services LLC can force arbitration of a complex business dispute with Black Knight Inc., including its own antitrust allegations and the trade secret misappropriation claims it faces, a federal judge in Jacksonville, Fla., ruled.

Judge Timothy J. Corrigan granted summary judgment for PennyMac, holding that it didn’t waive its arbitration rights by initially going to court. Arbitration wasn’t available “at the outset of the case,” and the lender invoked that option as soon as it could, he said.
