Bethune-Cookman Delay Forecloses Trademark Ban, 11th Cir. Says

Bethune-Cookman University Inc.'s delay in seeking to block an alumn group’s use of its trademark justified a lower court denying its bid, the Eleventh Circuit ruled.

The university waited more than six months to seek a preliminary injunction, undercutting its claim that Dr. Mary McLeod Bethune National Alumni Association Inc. would cause irreparable harm without a court order, the US Court of Appeals for the Eleventh Circuit said Tuesday.
