Berkshire Unit Nixes Parts of Two Stryker Joint Plate Patents

Berkshire Hathaway Inc.‘s OsteoMed LLC succeeded in defeating parts of joint plate patents that a subsidiary of rival, Stryker Corp., asserted against it in a federal lawsuit in Illinois.

Stryker European Operations Holdings LLC accused OsteoMed of infringing two patents—US Patent Nos. 9,078,713 and 10,993,751—in counterclaims filed after OsteoMed sued Stryker for alleged patent infringement based on its own portfolio of joint plate patents. The parallel litigation in the US District Court for the Northern District of Illinois was paused while the Patent Trial and Appeal Board resolved challenges by both companies targeting each other’s patents.
