Isabella Hadid, a 26-year-old American supermodel, was accused of infringing Chosen Figure LLC’s copyright by posting a photo of herself on Instagram, a federal lawsuit said.
Chosen Figure filed its complaint in the US District Court for the Southern District of New York on Wednesday, accusing Hadid of copying and displaying the photo without permission.
The complaint described Hadid’s account, followed by more than 59 million users, as “a part of a popular and lucrative commercial enterprise” which benefited from publishing the photo at issue. The image is of her wearing sunglasses, exiting an apartment door.
Chosen Figure observed the photograph posted to Hadid’s Instagram story on Aug. 16, 2020, according to the complaint. Instagram stories disappear from users’ feeds within 24 hours of posting, but the plaintiff included a screenshot of the allegedly infringing post in her complaint.
The plaintiff has filed at least seven other copyright infringement complaints this year against various entities in California, Washington, and Florida, including one on July 10 over a Facebook post depicting Hadid waving. The defendant in that lawsuit is Style Delivers Boutique LLC.
Judge Jennifer H. Rearden was assigned to the New York case.
Craig B. Sanders of Uniondale, N.Y., represents Chosen Figure LLC. Attorneys for Hadid aren’t yet listed on the electronic docket.
