Barstool Sports’ Use of Bikini Pic Draws Copyright Lawsuit

Barstool Sports Inc. is facing a copyright infringement suit in the Southern District of New York over its allegedly unauthorized use of a photographer’s work.

Plaintiff Elliot McGucken alleges Barstool published and hosted posts on its website and networks that “incorporated unauthorized copies” of his photograph of a bikini-clad woman and “hosted” unauthorized copies of the photo on its servers, according to a complaint filed Thursday in the U.S. District Court for the Southern District of New York.

McGucken asserts he created and owns the original photograph and that the photo was registered with the U.S. Copyright Office.
