Bankrupt Bang Energy, Monster Drop Second Reign Trade Dress Suit

Bang Energy has dropped trade dress claims against Monster Energy Co. over its redesigned Reign energy drink packaging months after Bang lost a separate $293 million false advertising verdict and filed for Chapter 11 bankruptcy.

Monster also dropped counterclaims in the lawsuit Vital Pharmaceuticals Inc.—which operates as Bang—brought over a redesign of the cans of Monster’s Reign line of drinks. Bang dropped its claims with prejudice, while Monster’s counterclaims can be raised again, as they were dismissed without prejudice, according to the stipulation in the US District Court for the Southern District of Florida.
