The Federal Circuit reversed a lower court’s injunction against EOFlow Co. Ltd.'s sale of insulin pump patches using Insulet Corp. trade secrets, finding a litany of deficiencies in the ban.
A preliminary injunction issued Monday against the medical device maker failed to properly establish a likelihood of success or irreparable harm, the US Court of Appeals for the Federal Circuit said. A Massachusetts federal court failed to address a statute of limitations or adequately define the trade secrets, Circuit Judge Alan David Lourie said.
