The self-proclaimed “Largest Cannabis Company in the US” can’t register trademarks for empty oil dispensers because they’re primarily intended to be sold as drug paraphernalia, a trademark tribunal said Wednesday.
National Concessions Group Inc. failed to provide evidence of any intended use for the products other than dispensing pre-measured amounts of cannabis oil to a vaping or smoking device, the Trademark Trial and Appeal Board wrote. The board also rejected a novel interpretation of an exemption because, even if NCG’s products are legal in Colorado, the rights it seeks to register would apply nationwide.
