Authors Suing OpenAI Must Turn Over Investigation Materials

OpenAI Inc. convinced a federal judge that it’s entitled to the methodology and data used by the author plaintiffs claiming the flagship ChatGPT chatbot copied hundreds of thousands of books without the authors’ permission.

OpenAI is entitled to examine the entirety of the authors’ test results, including the prompts authors fed into the generative AI tool that didn’t trigger responses reproducing or summarizing their works, because they’re necessary to fairly scrutinize the authors’ allegedly cherry-picked examples, according to an order filed Monday in the US District Court of the Northern District of California.
