Apple Takes Loss on Bid to Move Biometric Suit to Federal Court

Apple’s third attempt to force a proposed class action alleging it illegally profited from users’ biometric data into federal court has been rejected.

A state court’s order denying Apple’s motion to dismiss didn’t establish a basis for federal jurisdiction over the plaintiffs’ claim under section 15(c) of the Illinois Biometric Information Privacy Act, Judge Nancy J. Rosenstengel of the US District Court for the Southern District of Illinois said Monday.

Rosenstengel granted the plaintiffs’ motion to remand the case to the Circuit Court of St. Clair County, Ill.
