Apple Suit Seeks Judgment It Doesn’t Infringe Headwater Patents

Apple Inc. filed a complaint against Headwater Research LLC seeking declaratory judgment of non-infringement of three mobile device messaging and communication patents.

Apple seeks judgments of noninfringement of US Patent Nos. 8,639,935, 9,232,403, and 9,491,564, according to a complaint filed on Sept. 5 in the US District Court for the Northern District of California.

Headwater previously sued Apple in the Western District of Texas on Sept. 4, alleging that Apple’s mobile devices, servers, and Apple Push Notification service infringe the patents, according to the complaint. Apple argues the accused technology was developed before the alleged inventions by ...
