Apple, Shyamalan Face Trial in ‘Servant’ Copyright Lawsuit (1)

Creators of the Apple TV+ show “Servant” failed to convince a judge to grant them victory over revived claims they infringed a 2013 independent film, as the case now progresses toward trial.

Apple Inc., writer Tony Basgallop, and executive producer M. Night Shyamalan couldn’t establish they hadn’t seen and copied from “The Truth About Emanuel,” the US District Court for the Central District of California said. Writer and director Francesca Gregorini demonstrated enough similarity and factual disputes over access to require a jury to decide, the court said.
