A new trade proceeding involving redesigned Apple Watches highlights flaws in a two-year-old import ban
The US International Trade Commission’s new modification-and-enforcement proceeding on the redesigned Apple Watch shows that the agency wrongly credited Masimo with a qualifying domestic industry in 2021, relied on different prototypes for its technical and economic analyses, and applied uneven standards that made it harder for Apple to challenge infringement and validity, the tech giant said in supplemental briefing filed Tuesday at the US Court of Appeals for the Federal Circuit.
