Apple, Fintiv Texas Patent Trial Delayed For Case Move Appeal

A West Texas federal judge delayed the start of a patent trial between Apple Inc. and Fintiv Inc. to give the Federal Circuit time to weigh Apple’s complaint that he sent the case back to Waco.

Apple filed a mandamus petition with the U.S. Court of Appeals for the Federal Circuit Thursday, challenging U.S. District Judge Alan Albright’s decision to re-transfer the case from Austin to Waco, where it was originally filed. Jury trials in the Austin courthouse have largely been suspended since the Covid-19 outbreak.
