A federal judge in Brooklyn rejected Apple Inc.'s bid to transfer a suit to California over its alleged infringement of radio-frequency identification patents.
Varia Holdings LLC in October 2023 accused the tech giant of copying its inventions, including through an Apple Pay feature allowing New York City subway riders to use the service to pay fares. Apple said Varia signed a non-disclosure agreement as part of a licensing negotiation meeting in March 2013. The agreement included a forum-selection clause requiring any litigation “arising out of” it happen in Northern California where it’s headquartered.
