Apple Erases Tribunal Rejection of ‘Reality Composer’ Trademark

Apple Inc. convinced a Virginia federal judge to reverse a trademark tribunal’s refusal to register marks for “Reality Composer” and “Reality Converter” software.

The marks are suggestive and inherently distinctive, and even if they were merely descriptive Apple has shown they’ve acquired distinctiveness through publicized use of the marks since 2020, the US District Court for the Eastern District of Virginia said. The Trademark Trial and Appeal Board had sided with Turkish digital visualization firm ZeroDensity Yazilim Anonim Sirketi, which owns a registration for “Reality Hub” and pending applications for “Reality Engine” and “Reality Keyer.”
