Apple Defends ‘Servant’ Copyright Suit Dismissal to 9th Cir.

A Ninth Circuit panel isn’t tipping its hand about whether it will back a lower court’s ruling that Apple Inc.‘s “Servant” program didn’t infringe a director’s copyright, but has signaled it may scrap an attorneys’ fees award against the director.

An attorney for director Francesca Gregorini argued a lower court overemphasized differences while glossing over similarities as it tossed claims that M. Night Shyamalan’s Apple+ show infringed “The Truth About Emanuel” during oral argument at the U.S. Court of Appeals for the Ninth Circuit.
