Apple Bid in Qualcomm Patent Fight Not Ripe for SCOTUS, DOJ Says

Apple Inc. didn’t establish standing that would allowed it to appeal a review board’s decision to uphold Qualcomm Inc. patents, the Biden administration said in a brief recommending that the US Supreme Court not review the case.

The US Court of Appeals for the Federal Circuit ruled last year that Apple, which licensed the Qualcomm patents involved, had to show the appeals court it had an ongoing legal dispute concerning those patents to challenge Patent Trial and Appeal Board decisions in federal court.
