Apple Beats App Store Antitrust Claims for Third and Final Time

Allegations that Apple Inc. maintains a monopoly in the mobile operating systems market fail without patent infringement claims, which were previously dismissed, a federal court in Delaware held.

Email app maker Blix Inc. also “fails to adequately and plausibly allege how any action Apple is allegedly taking is harming competition,” the U.S. District Court for the District of Delaware said.

The court dismissed the complaint without leave to refile, saying “Blix has had multiple opportunities to state an antitrust claim (or patent claim) and has repeatedly failed.” It directed the clerk of court to close the case.
