Apple Asks Federal Circuit to Wipe Out ITC Watch Import Ban (1)

The US International Trade Commission exceeded its powers when the agency in late 2023 banned imports of Apple Watches that had a blood-oxygen measuring feature, Apple Inc. told a federal appeals court Monday.

The ITC shouldn’t have entertained Masimo Corp.'s complaint that led to its exclusion order—which led Apple to remove the feature—because Masimo wasn’t making a competing product using the patented technology at the time it lodged its complaint, Apple told the US Court of Appeals for the Federal Circuit during oral argument.
