Medical technology trade groups again failed to convince a federal judge that the Library of Congress illegally exempted medical device repair from an anti-hacking copyright statute.
The Library’s “thorough and well-reasoned explanations” validated the 2021 exemption it adopted under the Digital Millenium Copyright Act, the US District Court for the District of Columbia said. Allowing circumvention of technological protection measures for repair purposes likely satisfied the fair use requirement and is consistent with the purpose of the DMCA and copyright law, Judge Beryl A. Howell said.
