Patent law hasn’t kept up with technological developments in electronic commerce, but it’s up to Congress, not the courts, to address the issue, a federal judge said Nov. 3 in ruling that Amazon.com Inc. was not liable for patent infringement (Milo & Gabby, LLC v. Amazon.com, Inc., W.D. Wash., 2:13-cv-01932-RSM, 11/3/15).
Judge Ricardo D. Martinez sided with a jury in concluding that Amazon.com couldn’t be liable for allegedly infringing goods that others sold on its online platform. But Martinez said he was troubled by the implications of his own ruling.
