Amazon Attorneys’ Fee Award in Patent Case Upheld by Fed. Cir.

Amazon.com Inc. was properly awarded $723,000 in attorneys’ fees for winning a patent infringement suit brought by Innovation Sciences Inc., the Federal Circuit said.

Innovation continued to pursue the litigation after eight of its 11 patents related to e-commerce were invalidated and it was clear it would lose on the others, the U.S. Court of Appeals for the Federal Circuit said in an unsigned nonprecedential opinion. The lower court properly held the case exceptional enough to warrant fees, the Federal Circuit said.
