Allele, Pfizer Call Truce in Patent Dispute Over Covid-19 Vaccine

Pfizer Inc. and BioNTech SE have reached an agreement to end a patent suit alleging their Covid-19 vaccine was developed with the unauthorized use of a fluorescent protein.

Judge Marilyn Huff in the U.S. District Court for the Southern District of California on Wednesday granted a dismissal request that the companies filed along with the patent owner, Allele Biotechnology and Pharmaceuticals Inc.

The lawsuit, filed in October 2020, alleged the companies used Allele’s patented research tool to develop and test their vaccine candidate. A jury trial was set for late 2022.
