Alcon Can’t Block J&J Bid for Billions in Eye-Laser Profits (1)

Johnson & Johnson can seek the disgorgement of Alcon Inc.’s $3.1 billion in profits from a decade of selling artificial lenses that doctors use to replace the eye’s natural lens during cataract surgery, a federal judge ruled.

“I think the prudent course of action is to submit the disgorgement of profits claim to a jury and decide after I have had the benefit of post-trial briefing and argument whether to treat any disgorgement verdict as advisory or conclusive,” Judge Colm F. Connolly wrote in an order issued Wednesday in the US District Court for the District of Delaware.
