Alcon Vision LLC escaped a trio of Lens.com Inc. counterclaims and some of its defenses in the companies’ sprawling false advertising, trademark, and antitrust fight in the contact lens market.
Alcon, a division of Novartis AG until a 2019 spin-off, convinced the US District Court for the Eastern District of New York to dismiss two of Lens’ counterclaims based on allegedly misleading packaging. The court also dismissed a counterclaim for a declaration that Lens didn’t infringe Alcon’s trademarks, saying it was duplicative of its infringement defense.
