Albertsons Can’t Escape Software Seller’s Trade Secrets Claims

Grocery chain Albertsons Cos. must face claims it stole confidential information from the maker of a retail restocking software platform, a Washington federal court said.

Replenium Inc. sufficiently identified its claimed trade secrets and pleaded they were protectable and taken by the chain, according to the Tuesday opinion filed in the US District Court for the Western District of Washington. The court also refused to toss Replenium’s breach of contract claim in its entirety, though it did foreclose some of its allegations regarding particular parts of the contracts at issue.
