Reporter Inc. can’t challenge the patent office’s decision that it is barred from asking for a reexamination of Vivint Inc. patents on remote monitoring systems, a Virginia district court judge ruled.

The U.S. Patent and Trademark Office rejected’s request for ex parte reexamination of claims in three Vivint patents. The agency said was estopped from requesting the reexam because it had already challenged the patent claims in inter partes review. sued the agency under the Administrative Procedure Act, arguing the decision was arbitrary and capricious.
