AI Face Swap App Fails to Escape TV Celebrity’s Publicity Suit

The artificial intelligence-based face swapping app Reface was unable to shake a lawsuit from a reality TV celebrity claiming the app appropriated his image and likeness without consent or compensation.

US District Judge Wesley Hsu ruled Tuesday that the right-of-publicity claims made by Kyland Young, a contestant on the CBS reality competition show “Big Brother,” weren’t preempted by the federal Copyright Act and the First Amendment doesn’t protect the app maker NeoCortext Inc. from facing the suit.

Hsu had indicated during oral argument last month that he would likely deny the Ukraine-based company’s motion to dismiss.
