Affliction Holdings LLC will get another chance to prove that a Utah vape shop infringes its trademarks by using the word “Affliction” and a fleur-de-lis on its products, after a ruling by the Tenth Circuit.
The U.S. District Court for the District of Utah’s grant of summary judgment to the vape shop was improper, the U.S. Court of Appeals for the Tenth Circuit said Aug. 27.
