A New York federal judge sanctioned a patent owner for bringing a frivolous lawsuit against Aero Global LLC concerning an expired e-commerce systems patent but declined to extend liability to the lawyer who filed the suit.
AML IP LLC sued to assert US Patent No. 6,876,979 nine months after the patent expired, according to an opinion and order issued Thursday in the US District Court for the Southern District of New York. Citing AML’s pattern of failing to conduct an adequate prefiling investigation, Judge Dale Ho said there’s a “need to deter future frivolous and unreasonable suits.”
