Adidas Trademark Spat With Thom Browne Inches Closer to Trial

Adidas AG’s trademark fight with luxury fashion brand Thom Browne Inc. over the three-stripe design moved closer to trial after a Manhattan federal judge mostly denied the parties early wins.

US District Judge Jed S. Rakoff said in the two-page order filed Dec. 2 that he will issue an opinion explaining the decision by Dec. 16.

Rakoff granted Adidas’ motion for summary judgment on the question of trademark abandonment and whether Adidas told Thom Browne that it wouldn’t assert its trademark rights.
