A bovine semen company urged a skeptical Federal Circuit panel to wipe out a Madison, Wisc., jury’s $8.6 million patent infringement verdict against it.
ABS Global Inc. told three judges on the US Court of Appeals for the Federal Circuit during oral argument Wednesday that jurors from the US District Court for the Western District of Wisconsin whiffed when they declined in September 2019 to invalidate an STGenetics patent describing a way to sort semen samples based on gender. ABS said a 2003 academic paper authored by J.H. Nieuwenhuis covered the same technology.
