Abiomed Preserves Invalidity Bid in Heart-Pump Patent Lawsuit

Abiomed Inc. kept alive its bid to invalidate Maquet Cardiovascular LLC’s heart-pump patent after a Massachusetts federal judge declined to dismiss its written-description and enablement defenses.

Judge F. Dennis Saylor IV, in a mixed ruling issued May 1 in the US District Court for the District of Massachusetts, also barred Abiomed from pursuing separate indefiniteness challenges to two claim terms in US Patent No. 10,238,783.
