Abbott Wins Case-Ending Sanctions Against Diabetes Test Seller

A wholesaler sued by Abbott Labs for trademark infringement received case-ending sanctions from a Brooklyn federal court for committing a fraud on the court by withholding information in bad faith during discovery.

H&H Wholesale Services Inc. lied about how many responsive documents it had to reduce how much it would have to produce, and then purposely chose not to turn over relevant documents, the court said Tuesday.
