Abbott Labs Slapped With ‘Once Upon a Farm’ Trademark Suit

A San Diego-based organic baby food company is suing Abbott Laboratories Inc., the maker of baby formula Similac, for allegedly swiping its “Once Upon a Farm” brand name (Once Upon a Farm, LLC v. Abbott Labs., Inc., S.D. Cal., 17-419, complaint filed 2/28/17).

Once Upon a Farm’s lawsuit, filed Feb. 28, targets the pharmaceutical and nutritional products giant, which reported nearly $4 billion in U.S. and international sales of pediatric nutritional products in 2015. Abbott’s 2016 annual report claimed Similac as the No. 1 infant formula brand in the U.S.
