9th Circuit: DMCA’s Safe Harbor Protects Video-Sharing Site Veoh

Video-sharing website Veoh Inc.'s acts of formatting, advertising, and organizing of user uploads—including infringing content—did not take it beyond the reach of the Digital Millennium Copyright Act’s safe harbor, the U.S. Court of Appeals for the Ninth Circuit held Dec. 20 (UMG Recordings Inc. v. Shelter Capital Partners LLC, 9th Cir., 09-55902, 12/20/11).

The court reached several conclusions that reinforce the statute’s broad protections against intermediary liability under at 17 U.S.C. §512(c).
