The nation’s top patent court has become an unexpected battleground for lifetime federal judicial appointments, with its oldest and longest-serving member under unprecedented scrutiny over her fitness to remain on the bench.

In March, the US Court of Appeals for the Federal Circuit’s Judicial Council launched an investigation into Pauline Newman, sparking an uncharacteristically public employment clash within the judiciary.

Newman, 96, remains steadfast on carrying out her duties for a court on which she’s served since 1984. Her colleagues, including Federal Circuit Chief Judge Kimberly Moore, have raised red flags about Newman’s health issues and behavior. The dispute remains ongoing.
