5th Circuit Chastises District Judge in Counterfeit Rolex Case

A district court judge went beyond the instructions of an appellate panel when he altered a judgment Rolex Watch USA Inc. had won against a company found to be counterfeiting its products, the Fifth Circuit found.

The US Court of Appeals for the Fifth Circuit, in a published opinion Wednesday, vacated the US District Court for the Northern District of Texas’s amended judgment, reinstating the original judgment as modified by an earlier appellate decision and another change agreed to by the parties.
