The US Department of Commerce erred in calculating a countervailing duty on Gujarat Fluorochemicals Ltd.'s polytetrafluoroethylene resin in part based on a subsidy its energy supplier received from the Indian government, a federal appeals court said Wednesday.
The record is insufficient to show that Inox Wind Ltd.'s wind energy was “primarily dedicated” to the Indian manufacturer’s production of PTFE, the US Court of Appeals for the Federal Circuit said.
