Court Upholds Targeted Dumping Test, AD Duty Rate on Finnish Food Additive

A 12.06 percent antidumping duty rate applied to CP Kelco Oy’s imports of the food additive carboxymethylcellulose from Finland was upheld by the Court of International Trade March 25, according to a partially redacted opinion dated March 25 but released March 31 (CP Kelco Oy v. United States, 2015 BL 92119, Ct. Int’l Trade, 13-00079, 3/25/15).

The court found that the Commerce Department, after an earlier remand, had adequately explained why it applied a certain statistical test that contributed to its determination that the imports had undergone targeted dumping.
