Commerce Scope Ruling for AD Order On Chinese Candles Too Broad, Court Says

An antidumping duty order on certain petroleum wax candles from China will have to exclude specially-shaped or holiday-themed candles, the Court of International Trade ruled Jan. 31 (Trade Assocs. Grp., Ltd. v. United States, Ct. Int’l Trade, 11-00397, 1/31/14).

Judge Timothy C. Stanceu agreed with plaintiff Trade Associates Group, Ltd., a U.S. candle importer, that the Commerce Department had erred in finding that such novelty candles fall within the scope of the order.

The candles in question are in the shape of acorns, beach balls, flowers, fruits, snowmen, trees, witches’ hats and other identifiable shapes.
