Biden Administration Defends Trump Steel Tariffs on Appeal

The Trump administration’s rationale for imposing national security tariffs on imports of steel articles from around the world isn’t subject to court review, the Justice Department argued to the Federal Circuit on Wednesday.

Proclamation 9705, issued in 2018, imposed 25% tariffs on steel mill products from around the globe. The administration invoked Section 232 of the Trade Expansion Act, which authorizes the president to temporarily restrict imports for the sake of national security.
