Zurich American Insurance Co. defeated Great American Assurance Co.'s attempt to collect $25 million in reimbursements for settling litigation surrounding their policyholder’s work on San Francisco’s sinking Millennium Tower.
Great American, a unit of American Financial Group, failed to show it was entitled to reimbursement, an element that Great American must prove at trial, the US District Court for the Northern District of California’s ruled Tuesday, in granting Zurich’s summary judgment bid.
In 2016, the Millennium Tower Association and certain homeowners sued the contractor, Webcor Builders, alleging that construction defects caused the 58-story building to sink and tilt.
