While the underlying suit claims Round One Entertainment Inc. violated Washington state’s Equal Pay and Opportunities Act, which covers discriminatory practices, a putative class of job applicants didn’t allege discrimination as defined by the insurance policy, according to a Tuesday opinion from the US District Court for the Western District of Washington.
“The underlying action uses the word ‘discrimination’ but does not allege discrimination as defined in the policy,” Judge Ricardo S. Martinez said.
