Tokio Marine Unit Sues Quartz Surface Maker Over Silica Cases

A Tokio Marine Holdings Inc. insurance unit is suing Cambria Co., seeking a declaration that it has no duty to defend or indemnify the company in numerous bodily injury lawsuits alleging exposure to harmful dust from Cambria’s quartz products.

Policies issued by Philadelphia Indemnity Insurance Co. to Cambria that were in effect from November 2000 to November 2002 contained pollution exclusions that bar coverage for the underlying lawsuits, which generally allege injuries from exposure to respirable crystalline silica dust from fabricating and installing Cambria’s quartz surface products, the insurer said in a complaint Wednesday in the US District Court for ...
