Tokio Marine Unit Sues Maryland Boarding School Over Abuse Case

A Tokio Marine Holdings Inc. unit sued a Maryland boarding school, seeking a court declaration that the insurer has no duty to defend or pay damages in a sexual abuse lawsuit because the alleged conduct occurred outside its policy period.

The commercial general liability policy issued by Philadelphia Indemnity Insurance Co., which ran from August 2008 through August 2009, doesn’t cover a former student’s allegations that a teacher at Oldfields School sexually harassed and abused her starting in 2005, the insurer said in a complaint filed Monday in the US District Court for the District of Maryland.
