The Hartford Unit Wins Manufacturer’s D&O Insurance Appeal

A Hartford Financial Services Group Inc. unit won an insurance dispute after the Second Circuit freed it from covering a Kentucky manufacturer’s former employee’s defense costs under a directors and officers insurance policy.

Navigators Insurance Co. is not on the hook for Thomas Gregory’s underlying legal fees because the policy bars coverage for lawsuits between policyholders, the US Court of Appeals for the Second Circuit said on Monday, upholding a lower court ruling.

Gregory was a “high-level employee” at Tarter Gate Company LLC, and was insured under Navigators’ D&O policy, according to the order. Tarter is a farm equipment manufacturer. ...
